These General Conditions of Sale are concluded between:

Placing an Order implies that the CUSTOMER acknowledges having read and accepted without reservation these General Conditions of Sale.

Article 1: APPLICATION OF THE GENERAL CONDITIONS OF SALE
1.1 These conditions aim to define the terms of sale between the company BED REPUBLIC, owner of the website sommeil-et-tradition.fr and the CUSTOMER, the latter being understood as any person wishing to acquire a Product put on sale by the Seller on its Site. It is specified that certain provisions of these conditions do not apply to foreign Customers according to the conditions set out for each article concerned.
They regulate all the steps necessary for placing the Order and ensure the monitoring of this Order between the contracting parties.
1.2 Placing an Order implies full acceptance by the CUSTOMER and full adherence to these general terms and conditions of sale which prevail over any other CUSTOMER document, unless expressly agreed otherwise by our company.
1.3 The fact that sommeil-et-tradition.fr does not assert at any given time any of the general conditions of sale cannot be interpreted as a waiver of the right to assert any of the said conditions at a later date.
If a condition were to be lacking, it would be considered to be governed by the practices in force in the sector of distance selling with consumers.
1.4 sleep-and-tradition.fr reserves the right to modify its general terms and conditions of sale. Any new version of the general terms and conditions of sale will be posted online on the website sommeil-et-tradition.fr . These modifications are binding from the time they are posted online and cannot apply to Orders placed previously
Article 2: ACCESS TO THE SERVICE
2.1 Although we endeavour to ensure that the website sommeil-et-tradition.fr is normally available 24 hours a day, access to the Site sommeil-et-tradition.fr may be temporarily suspended at our discretion and without notice for any reason including, but not limited to, system failure, maintenance or repair and reasons beyond our control. We will have no liability to you or any third party if, for any reason, the site sommeil-et-tradition.fr is unavailable at any time or for any period.
2.2 We reserve the right to modify or withdraw the website sommeil-et-tradition.fr, temporarily or permanently (or any part thereof) with or without notice and will have no liability to you or any third party for any such modification or withdrawal.
Article 3: FORMATION OF THE ORDER
3.1 When the CUSTOMER confirms his Order by clicking on the “Place my Order” or “Validate Payment” icon, he is considered to have knowingly accepted the content and conditions of the Order in question and in particular these General Conditions of Sale, the prices, characteristics, quantities and delivery times of the Products offered for sale and ordered by the CUSTOMER.
BED REPUBLIC will then confirm this Order by sending an email to the CUSTOMER.
3.2 In addition, BED REPUBLIC reserves the right to suspend or cancel any execution of an Order and/or delivery, whatever its nature and level of execution, in the event of non-payment or partial payment of any amount that would be due by the CUSTOMER, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Site, including in the event of previous Orders.
In the event of an error in entering the email address concerned, or non-receipt of the Order confirmation email, BED REPUBLIC shall not be held liable. In this case, the sale will be considered final, except in cases of cancellation of the Order by BED REPUBLIC, in particular due to unavailability of the Products.
BED REPUBLIC also reserves the right to cancel an Order or suspend it for internal reasons (out of stock, disruption of the logistics service, etc.), the CUSTOMER will be reimbursed for the costs incurred on this Order but will not be able to claim any compensation.
3.3 By placing an Order on sommeil-et-tradition.fr , you declare that you are of legal age and fully capable of entering into a contract.
Article 4: PRODUCTS AND PRESENTATION OF PRODUCTS
4.1 The CUSTOMER placing an Order declares that they have read the details of the Products indicated on the Product page or in the FAQs or, failing that, have contacted CUSTOMER service if they consider that they are missing information.
4.2 BED REPUBLIC reserves the right to modify the design, manufacturing, materials or any other element of its Products at any time and to notify the CUSTOMER by updating its website sommeil-et-tradition.fr . Information on the website sommeil-et-tradition.fr on the day of the Order are those which are authentic.
4.3 In accordance with Article L.111-1 of the Consumer Code, the company BED REPUBLIC aims to inform the CUSTOMER and enable them to know the essential characteristics of the Product. It is specified that the photographs, graphics and descriptions of the Products offered on the site are for information purposes only and do not fall within the contractual scope. The company BED REPUBLIC undertakes to ensure that the photographic representation of the Products or services on the Site sommeil-et-tradition.fr is as faithful as possible to the Products or services themselves. However, given the digital presentation method of the Products or services on the sommeil-et-tradition.fr network, it is possible that the CUSTOMER's perception of the photographic representation of the Products or services does not correspond exactly to the Product or service itself, which the CUSTOMER admits and acknowledges.
4.3 The Products comply with current French legislation.
4.4 BED REPUBLIC reserves the right to make the offer on its website completely free. BED REPUBLIC may therefore modify the Products and/or services offered for sale on its Website at any time without informing the CUSTOMER in advance and without prejudice to Orders placed by the CUSTOMER.
Article 5: PRICE
5.1 The prices indicated on the website sommeil-et-tradition.fr are indicated in euros, including VAT (All Taxes Included) and include shipping and logistics costs for mainland France.
5.2 If the VAT rate in force were to be modified, the prices of the items could be modified accordingly, without the CUSTOMER being informed in advance.
BED REPUBLIC reserves the right to modify its prices without notice and at any time. Billing is done at the rate in effect at the time of registration and acceptance of the Order.
5.3 The Products remain the property of BED REPUBLIC until full payment of the price. This price is payable in full and in a single payment (except for a specific payment arrangement in several installments).
BED REPUBLIC reserves the right to cancel or not validate an Order for which the payment of this Order or a previous Order of the CUSTOMER presents a dispute or suspicion of fraud.
Article 6: PAYMENT TERMS
6.1 The payment methods accepted for the Products are indicated on our site during the Order process.
6.2 Where the CUSTOMER pays by credit or debit card, the card will be debited at the time the payment is approved. However, all credit or debit card payments must then be authorised by the card issuing institution.
6.3 If the CUSTOMER has already paid for Products which, exceptionally, cannot be delivered to the CUSTOMER, the CUSTOMER will be reimbursed as soon as possible and in any case within 15 days following receipt of payment.
6.4 In the event that payment is not received by BED REPUBLIC and Products have already been received by the CUSTOMER, the CUSTOMER must pay for the Products within 14 days or return them at its own expense as soon as possible. In such a case, the CUSTOMER must keep the Products in its possession, take reasonable care of them (ensuring that all instructions or manuals provided with the Products are scrupulously followed) and not use them before returning them.
6.5 If the CUSTOMER does not return the unpaid Products within 14 days, BED REPUBLIC has the right to recover said Products from the CUSTOMER at its own expense, and to charge it for any depreciation that the Products may have suffered while they were in its possession.
6.6 The price of the Products is displayed and due in euros (€)(EUR) for Products purchased in France.
6.7 The price includes VAT (and other applicable taxes) at the applicable rate and the cost of standard delivery.
Article 7: AVAILABILITY OF PRODUCTS
7.1 The offers presented by sommeil-et-tradition.fr are valid as long as they are announced on the Site.
In the event of unavailability of one or more Products after placing the Order, the CUSTOMER will be notified by e-mail or telephone. The amount of his Order will be recalculated and the CUSTOMER will be debited with the new amount, less the missing Products. If the Order is completely unavailable, the CUSTOMER will be notified by e-mail or telephone and will not be debited (or refunded). In the event of unavailability of the Products before or after placing the Order, BED REPUBLIC cannot be held responsible for any loss suffered by the CUSTOMER, nor liable for any damages.
Article 8: NON-ACCEPTANCE OF ORDERS BY US
8.1 BED REPUBLIC is entitled not to accept or respond to any Order at its sole discretion, including, but not limited to, in the event that:
8.1.1 payment is refused;
8.1.2 it does not have sufficient stock to deliver the Product that the CUSTOMER has ordered;
8.1.3 it does not deliver to the region of the CUSTOMER’s delivery address;
8.1.4 it is not possible or practical to deliver to the delivery address specified by the Customer or because of any other problem with that delivery address.
8.2 In the event of a refused Order, BED REPUBLIC will not be required to provide compensation for any losses or disappointment suffered by the CUSTOMER.
Article 9: DELIVERY
9.1 Delivery is only possible in metropolitan France. If the CUSTOMER's address is not eligible for delivery and the CUSTOMER wishes to Order and receive Products, he/she can submit his/her request via the contact form
9.2 Delivery takes place from Monday to Saturday (except public holidays) and a person over 18 years of age must be present at the delivery address when the Product is delivered. Once the Order has been placed, the delivery address cannot be changed. In the event of a need to change the delivery address after placing an Order, the CUSTOMER must make their request as soon as possible via the contact form
9.3 The estimated delivery time of a Product is based on the presence of the Product in stock and on the delivery address that the CUSTOMER has provided and is subject to the receipt of payment for this Product. BED REPUBLIC takes all necessary measures to ensure that the Products are delivered within the estimated delivery time, but this date is indicative and delivery can in no case be guaranteed on this date. However, unless otherwise agreed with the CUSTOMER, any Product will be delivered within 45 days from the date of receipt of payment for this Product.
9.4 The CUSTOMER must make itself known, via the contact form, if there are any special circumstances to be taken into account regarding its delivery and the estimated delivery date, including, but not limited to, factors related to access: to your delivery address (e.g. low bridges, narrow streets etc.); and/or access to the premises at your delivery address (e.g. small door frames, narrow passages, steps etc.). The CUSTOMER must take appropriate measures to confirm the presence or absence of such factors.
9.5 The CUSTOMER may be required to pay an additional delivery cost in the following cases:
9.5.1 If the delivery service provider is unable to make a delivery because no person over the age of 18 is present at the delivery address to accept the Product on the delivery date;
9.5.2 If the CUSTOMER attempts to change the delivery address after the Product has been shipped; and/or
9.5.3 the CUSTOMER has failed to notify BED REPUBLIC of special circumstances concerning its delivery.
9.6 Although BED REPUBLIC will use its best efforts, it cannot guarantee that it is able to and reserves the right to refuse at its sole discretion to:
9.6.1 transfer the existing equipment to the delivery address (and any such request is made at the CUSTOMER's own risk); and/or
9.6.2 deliver the Product to a specific location within the premises of the CUSTOMER's delivery address
Article 10: DELIVERY AND TRANSFER OF RISK
10.1 Regardless of any retention of title clause and/or full payment, the transfer of risks occurs upon delivery, at the time when the CUSTOMER takes physical possession of the Products at the delivery address indicated by the CUSTOMER, or from the Carrier.
10.2 Without prejudice to the time period available to the CUSTOMER to exercise his right of withdrawal, upon receipt of the Products, it is the responsibility of the CUSTOMER or the recipient to ensure that the Products delivered correspond to his Order, and to check the condition and conformity of the Products in relation to his Order.
10.3 The CUSTOMER (or, if applicable, the recipient) will formalize his acceptance of the delivery by signing the delivery receipt issued by the carrier. If, upon delivery, the external appearance of the package is not perfect, the CUSTOMER or the recipient of the Products will open the package in the presence of the carrier in order to check the condition of the Products. In the event of damage resulting from transport, the CUSTOMER must refuse the damaged Products and indicate "refusal due to damage" on the return slip.
10.4 In the event of an apparent defect in the package, the CUSTOMER must make all reservations and complaints that appear justified; it will be up to them, if necessary, to refuse the package.
10.5 Without prejudice to the guarantees that the CUSTOMER benefits from under the legal and commercial guarantees and the right of withdrawal, for any claim relating to an apparent defect or damage during delivery of the Product, the CUSTOMER must contact CUSTOMER Service as soon as possible in order, on the one hand, to preserve the rights of the company BED REPUBLIC vis-à-vis the carrier, and on the other hand, in the event that the Product is still in the possession of the CUSTOMER, to initiate the return procedure under the conditions provided for below.
10.6 In the event of refusal of delivery or return of the Product for the reasons listed above, the CUSTOMER may request a new delivery or cancellation of his Order under the conditions provided for in respect of the conformity of the Products.
Article 11: RIGHT OF WITHDRAWAL
11.1 The CUSTOMER has a legal period of 14 days from the delivery of the Products (the day on which the CUSTOMER, or a third party designated by you, other than the carrier, takes possession of the Products) to exercise his right of withdrawal from any sales contract with the company BED REPUBLIC, and to subsequently return these Products, without having to give a reason.
11.2 In accordance with the Consumer Code, the statutory right of withdrawal cannot be exercised for goods that have been unsealed after delivery by consumers and that cannot be returned for reasons of hygiene or health protection. Therefore, if the CUSTOMER wishes to return a pillow or duvet, the Product must remain as it was delivered, and if possible in its original packaging. For reasons of hygiene, these Products are not suitable for return, and the CUSTOMER will not be able to exercise your statutory right of withdrawal for any mattress topper, pillow or duvet that has been unsealed after delivery and shows signs of use within the first 14 days.
11.3 Alternatively, the CUSTOMER may be held liable in accordance with Article L.221-33 of the Consumer Code in the event of depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Products. Consequently, BED REPUBLIC may deduct from the amount of the refund of the Products any depreciation in value of the Products resulting from its improper handling of the pillow or duvet.
11.4 If the CUSTOMER wishes to exercise his right of withdrawal, he must clearly notify his intention to withdraw within 14 days from the delivery date, via the contact form. This notification must include: his name; address; Order number; Order date; the date on which his Product was received.
Article 12: 100 NIGHTS TRIAL
12.1 sommeil-et-tradition.fr allows the CUSTOMER to test their new mattress for 100 nights and thus ensure that it corresponds to their morphology and requirements. If after a minimum trial of 15 days, the CUSTOMER is not satisfied with their mattress, sommeil-et-tradition.fr offers the possibility of exchanging it (no refund) for a model of the same or higher price in exchange for the return of the mattress or mattress topper. The exchange will be made on the size initially chosen
12.2 The trial period expires at 24:00 on the 100th day from the date the mattress was delivered.
12.3 This right must be exercised within the 100-day period
12.4 Following notification of his intention to exchange his Order, the collection of the Product must be organized and executed no later than 14 days from the date on which the CUSTOMER notified his intention to cancel. Failure to organize the collection may, except in exceptional circumstances (which must be communicated), invalidate his right to cancel the contract under this contractual right of return.
12.5 A Mattress Order can only be exchanged once during the 100-night trial period. Any mattress ordered subsequently will not be accompanied by the 100-night trial period.
12.6 If a claim is made under the statutory warranties in accordance with Article 11 and a replacement mattress is delivered to the CUSTOMER, his 100-night trial period will be suspended and will continue upon receipt of the replacement mattress. Claims under these rights do not limit his claim to his total of 100 nights to try the mattress (or any replacement mattress). If a claim is made under the commercial mattress warranty, in accordance with Article 11, the CUSTOMER will no longer be entitled to make an exchange during the 100-night trial period.
12.7 The 100-night trial period applies to mattresses only, not to other Products.
Article 13: RETENTION OF TITLE
13.1 In accordance with Articles 2367 et seq. of the Civil Code, the Products are sold subject to retention of title. BED REPUBLIC retains ownership of the Products until full and effective payment of the price by the CUSTOMER.
13.2 In the event of non-payment on the due date, BED REPUBLIC may indicate the products and cancel the sale, at the expense, risk and peril of the CUSTOMER.
Throughout the retention of title, the CUSTOMER undertakes to take the necessary measures to avoid all risks and all damages which could affect the Products subject to the retention of title.
Article 14: PROCEDURES FOR RETURNING PRODUCTS
14.1 The CUSTOMER must send their return request via the contact form or by contacting by telephone on 0 805 035 535. For a mattress, a mattress topper, a box spring or a headboard, the company BED REPUBLIC will organize the return with its logistics partner, who will come and collect it directly from the CUSTOMER.
14.2 The return costs will be €60 and must be paid prior to the collection of the returned Product. For other Products, the CUSTOMER is invited to return them to the address below by Colissimo at their own expense by dropping off their return package at the post office of your choice:

14.3 Returned items must be in new condition, in their original packaging, accompanied by their invoice. If after inspection of the returned Products, they show signs of use or alteration, BED REPUBLIC reserves the right not to proceed with the exchange or refund.
14.4 In all cases, the CUSTOMER must make contact via the return form before organizing their own return.
14.5 Depending on the Product to be returned, a collection appointment will be set according to the CUSTOMER's availability. In the event of collection at home, the CUSTOMER must be available on the date and time of the appointment set to transmit the Product to the logistics partner in charge of collection.
14.6 BED REPUBLIC reserves the right to re-invoice the CUSTOMER once again for the return transport costs of €60 in the event of the CUSTOMER's absence at the first scheduled appointment.
Article 15: GUARANTEES
15.1 Legal guarantees: BED REPUBLIC is liable for any lack of conformity of the goods in accordance with Articles L. 217-4 et seq. of the Consumer Code as well as for any hidden defect relating to the goods in accordance with Articles 1641 et seq. of the Civil Code.
The commercial warranty, as described in Article 15, applies without prejudice to the legal rights of the CUSTOMER as described in this article.
15.2 Guarantee of conformity: In accordance with the provisions of Articles L.217-4 et seq. of the Consumer Code, BED REPUBLIC delivers goods that comply with the contract and is liable for any lack of conformity that exists upon delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed at his expense by the contract or has been carried out under his responsibility.
In accordance with Article L. 217-5 of the Consumer Code, goods comply with the contract:
1° If it is suitable for the use usually expected of a similar good and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
In accordance with Article L. 217-12 of the Consumer Code, any action resulting from a lack of conformity is subject to a limitation period of two years from delivery of the goods.
In the event of a lack of conformity, within 2 years following delivery of the Product, the CUSTOMER has the right to request that BED REPUBLIC:
(a) repairs the lack of conformity of the purchased good or replaces the latter free of charge, in accordance with Article L. 217-9 of the Consumer Code; or
(b) reduce the price appropriately, or terminate the contract, in accordance with Article L. 217-10 of the Consumer Code.
BED REPUBLIC may, however, choose not to proceed according to the CLIENT's choice if this choice entails a cost that is clearly disproportionate compared to the other option, taking into account the value of the goods or the significance of the defect.
For the period of 24 months following delivery of the goods, the CUSTOMER is exempt from providing proof of the existence of the lack of conformity.
15.3 Warranty against hidden defects: the CUSTOMER may also exercise the warranty against hidden defects as defined by Article 1641 of the Civil Code. In accordance with Article 1641 of the Civil Code, the seller is required to provide a warranty against hidden defects in the item sold that render it unfit for the use for which it is intended, or that so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known about them. In this case, the CUSTOMER may choose between the cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code. In accordance with Article 1648, paragraph 1 of the Civil Code, the action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.
15.4 Commercial Guarantees
15.4.1 BED REPUBLIC guarantees the replacement of any mattress with a material defect within 10 years from the date of delivery, subject to the full conditions set out here: Guarantees
These warranties do not affect and are in addition to your statutory warranty rights.
In accordance with Article L.217-16 of the Consumer Code, when the buyer asks the seller, during the course of the commercial guarantee granted to him upon the acquisition or repair of a movable good, for a repair covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run. This period runs from the request for intervention by the buyer or from the provision for repair of the good in question, if this provision is subsequent to the request for intervention.
Article 16: RESPONSIBILITY
16.1 The company BED REPUBLIC only has an obligation of means in all stages of access to the site, visit, entry of forms, placing of Orders but is also bound by an obligation of conformity with regard to the preparation of Orders, delivery of Orders, returns of Products, exchange and possibly reimbursements of Orders to be exchanged or reimbursed.
16.2 The liability of the company BED REPUBLIC is, in any event, limited to the amount of the Order and cannot be called into question for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the Products and the execution of the service by the company BED REPUBLIC.
16.3 BED REPUBLIC may not be held liable, towards a member or a third party, for any indirect damage, loss of business, profit or turnover, occurring in any way whatsoever, even if this damage or loss or prejudice was foreseeable by BED REPUBLIC, or if its possibility had been brought to its attention.
Article 17: PERSONAL DATA
17.1 The CUSTOMER is responsible for the accuracy and completeness of the personal data that he provides on the website sommeil-et-tradition.fr and he guarantees that this data is accurate and complete in all respects. The CUSTOMER agrees to report any modification of said data that he can modify and update at any time from his account.
17.2 The provision of the bank card number and the final validation of the Order will constitute proof of acceptance of said Order and will constitute due date for the sums committed by the entry of the Products appearing on the Order. The computerized records, kept in the computer systems of the company BED REPUBLIC and its partners will be considered as proof of communications, Orders and payments between the Parties.
17.3 Privacy and Security Policy
17.3.1 If the CUSTOMER wishes to purchase Products on the website sommeil-et-tradition.fr , he must provide certain personal information in order to place his Order.
17.3.2 The CLIENT's personal information will be stored securely. The CLIENT may contact BED REPUBLIC at any time to access their information and verify that it is correct and up to date and to make the requests listed in article 17.3.4
17.3.3 BED REPUBLIC reserves the right to transmit from time to time certain personal information of the CUSTOMER to third parties for the purposes of direct prospecting linked exclusively to BED REPUBLIC, for Products and services that BED REPUBLIC believes may interest the CUSTOMER as a CUSTOMER of BED REPUBLIC. The CUSTOMER is free to refuse any direct prospecting at any time by notifying his refusal in writing via the contact form
17.3.4 Regardless of the CUSTOMER's choice to subscribe or not to the newsletters offered by the company BED REPUBLIC, the company BED REPUBLIC may use the email address entered in the shopping cart for an automated device called cart abandonment for 14 days during which the CUSTOMER may receive up to 4 emails to remind him of his uncompleted purchases. This device stops automatically and does not require any action on the part of the CUSTOMER.
17.3.5 In compliance with the European General Data Protection Regulation (GDPR) implemented since May 25, 2018, the CLIENT can modify all of their personal information independently, via their CLIENT account and benefits from the following rights:
-Transparency on CUSTOMER data held by the company BED REPUBLIC: the CUSTOMER can request at any time via the contact form to have access to all personal data held by the company BED REPUBLIC
-Right to be forgotten: CUSTOMER data is kept for a maximum of 3 years if the CUSTOMER has no activity or connection to his CUSTOMER account. The CUSTOMER may request at any time the partial or total deletion of personal data held by BED REPUBLIC
- Data portability: the CLIENT may request at any time an export of their CLIENT data, in particular their personal information and request history, in order to transmit them freely to a third party.
Article 18: CUSTOMER ACCOUNT AND PASSWORD
18.1 To access certain features of the website sommeil-et-tradition.fr and/or to place an Order, the CUSTOMER must register and create an account. To do this, the CUSTOMER must create a password, provide certain personal data including his name and email address as well as other details (for example his address) that may be necessary for the registration procedure; the CUSTOMER must also accept the processing by the company BED REPUBLIC of his personal data, in accordance with article 17. As mentioned above, if the CUSTOMER does not accept the conditions specified in article 17 of these GTC, the CUSTOMER must not use the website sommeil-et-tradition.fr or create an account.
18.2 BED REPUBLIC implements the necessary means to protect the personal information of its CUSTOMERS by ensuring a high level of security, but the CUSTOMER also has a role to play in protecting his personal data. In particular, the CUSTOMER must maintain the security of his online transactions by not communicating his identifier for example (CUSTOMER's email address) and/or his password to anyone and by regularly changing his password. As such, BED REPUBLIC cannot be held responsible for the disclosure of information concerning the CUSTOMER to any individual who has used his identifier (CUSTOMER's email address) and/or his password.
In this respect, the use of the identifier (email address of the CUSTOMER) and/or the password of the CUSTOMER will constitute proof of his identity, and the payment, upon validation of the Order, of the corresponding sums. The company BED REPUBLIC may not be held responsible for the fraudulent use of this information.
18.3 The CUSTOMER is responsible for the security and confidentiality of the password and other login details for his account. The CUSTOMER acknowledges his responsibility for all activities carried out from his account. If the CUSTOMER has a valid reason to suspect that his password is known to someone else and/or that his account has been or is likely to be used without his authorization, he must immediately contact sommeil-et-tradition.fr via the contact form. BED REPUBLIC will not be held responsible for any loss or damage resulting from the CUSTOMER's failure to protect the password and/or other login details related to his account.
Article 19: INTELLECTUAL PROPERTY
19.1 sommeil-et-tradition.fr is a registered trademark in certain countries. The website sommeil-et-tradition.fr may also include trademarks belonging to third parties; all these trademarks are the property of their respective owners.
19.2 All elements reproduced on the website sommeil-et-tradition.fr and in particular but not exclusively the texts, comments, works, illustrations, images and brands are protected worldwide under copyright and intellectual property rights. Any total or partial reproduction of the elements accessible on the Site on any present or future medium is strictly prohibited.
Article 20: ENTIRETY
20.1 These General Conditions and the Privacy Policy constitute the entire contract relating to the use by the CUSTOMER of the website sommeil-et-tradition.fr and to the Orders for any Product placed by the CUSTOMER, via the website sommeil-et-tradition.fr and cancel and replace all and each of the contracts previously concluded between the CUSTOMER and the company BED REPUBLIC concerning the use of the Website sommeil-et-tradition.fr and/or the Orders for said Product placed by the CUSTOMER.
20.2 No term expressed by any person in the customer service or sales department on behalf of BED REPUBLIC shall be understood as a modification of these General Conditions or as an authorized statement relating to the nature or quality of the Products offered for sale. Except in the event of fraud or fraudulent misrepresentation, BED REPUBLIC declines all liability in relation to such a statement.
Article 21: DURATION
